Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Omoggle Game website, web app, APIs and related services (collectively, the "Service") operated by the Omoggle Game team, a sole operator doing business as Omoggle Game ("Omoggle", "we", "our" or "us"). Legal and billing notices: support@omogglegame.com. By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. The Service is for users 18 years or older only.

0. What this Service is — and what it is NOT

For the avoidance of doubt and to align with our payment partner's merchant policies, the Service is:

1. Eligibility & account

The Service is restricted to users aged 18 years or older. By entering the arena you affirm that you meet this age requirement. We use a session-scoped 18+ acknowledgment gate; this is not a legal ID verification. You are responsible for accurate self-reporting and for any use of the Service from your device.

The Service is intended for personal, non-commercial use. You may not resell, sublicense, white-label, scrape, harvest or systematically extract data from the Service without prior written permission.

2. The arena, PSL scan and ELO

The Service offers timed 1v1 video face-offs ("mog battles"), an on-device facial keypoint scan that produces a private "PSL" score, and a global ELO leaderboard. PSL scores and ELO are entertainment metrics — they have no clinical, medical or social-science meaning. You agree not to rely on them as advice of any kind.

Match outcomes, audience votes and ELO movements are final. We may adjust ELO for accounts that abuse the system (collusion, bots, alt accounts, vote manipulation, etc.). We may refuse, suspend or terminate access at our sole discretion in cases of abuse.

3. Camera, microphone and live video

The Service uses your device camera through your browser's standard permission prompt. Camera frames are processed locally and streamed peer-to-peer to your matched opponent for the duration of a round. By turning on your camera you grant the matched user a temporary ability to view your live feed for the round.

You are solely responsible for what your camera captures. Do not turn on your camera in any context that violates these Terms, our Acceptable Use Policy, or the rights of any third party (including bystanders captured on camera).

4. Acceptable use

You agree to comply with our Acceptable Use Policy. In particular, you may not use the Service to:

We reserve the right to remove content, throttle accounts and ban users who violate these rules — without refund and without notice.

5. Pricing, payments & Merchant of Record

Most features are free. Optional paid products currently offered:

Prices on the pricing page are exclusive of tax. Applicable VAT/GST/sales tax is calculated and shown at checkout. Card details are entered on the payment partner's hosted page and never reach Omoggle servers.

5.1 Who is the seller (new vs existing customers)

New purchases initiated from this website after 9 September 2026 are processed by Waffo Pancake as Merchant of Record when that checkout is offered. Waffo Pancake is the legal seller on the receipt and statement for those orders, and handles tax collection for that transaction.

Existing purchases completed through Subotiz or Creem (Armitage Labs OÜ) remain valid. Recurring Subotiz subscriptions continue to be billed by Subotiz until you cancel them or they lapse. We continue to recognize those entitlements. This document does not cancel or migrate an old subscription by itself.

5.2 Auto-renew authorization (monthly VIP)

By starting Omoggle VIP Monthly you expressly authorize the Merchant of Record for that checkout (Waffo Pancake or, for existing Subotiz subscribers, Subotiz) to charge USD $4.99 plus applicable tax to your payment method at the start of each monthly period until you cancel under §5.3. There is no free trial that converts to a paid plan. Lifetime VIP and Face Tests are one-time charges only.

5.3 How to cancel

Cancel online at any time from omogglegame.com/billing:

Cancellation takes effect at the end of the current paid period. You keep access until that date; no further charges after that. Confirmations are sent to the billing email. See also the Cancellation Policy.

Access is linked to the email used at checkout. Sharing, reselling or transferring paid access is prohibited and may result in revocation without refund.

6. Refunds & chargebacks

Within 14 days of purchase, email support@omogglegame.com with your order ID for a no-questions-asked refund of unused one-time products and of the first monthly VIP charge. After 14 days, refunds are case by case. Refunds may be declined for accounts that violate these Terms or the Acceptable Use Policy. Full details: Refund Policy.

The Merchant of Record for your order (Waffo Pancake, Subotiz, or Creem) may also issue a refund on its own authority to prevent chargebacks. If you do not recognize a charge labeled Waffo, Subotiz, Creem, Armitage Labs, or Omoggle, contact us before opening a card dispute.

7. Privacy

Our handling of personal data is described in the Privacy Policy. Arena PSL scoring runs on-device. Live 1v1 video is peer-to-peer. Cloudflare R2 and kie.ai receive a photo only when you purchase a Face mini-game and submit a photo for that paid result. Those files are not used to train our own models. Purchase records are retained via the relevant payment partner (Waffo Pancake, Subotiz, or Creem). The site may display Google AdSense ads on free pages; see Privacy §6 and the Cookie Policy.

Face mini-game quality and availability depend on Google’s Gemini 2.5 Flash model (via kie.ai). You may not use those features to generate or present the categories listed in Acceptable Use — Content Standards and Prohibited Categories.

8. Intellectual property

The Service, including its design, code, branding, copy, audio and imagery, is owned by Omoggle Game and protected by copyright, trademark and other laws. You retain ownership of content you create or display through your camera; by using the Service you grant us a limited, royalty-free license to transmit and display that content for the purpose of operating the Service. We do not claim any rights to your face or likeness beyond what is necessary to provide the matchmaking and audience-voting functionality.

9. Termination

We may suspend or terminate your access at any time for violation of these Terms, our Acceptable Use Policy, or for legal, operational or security reasons. You may stop using the Service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, indemnity, limitation of liability, governing law) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted operation. PSL, ELO, rank and any other metric are for entertainment purposes only. Audience votes are subjective and do not reflect the views of Omoggle Game. We do not guarantee match availability, audience turnout or specific outcomes.

11. Limitation of liability

To the maximum extent permitted by law, Omoggle Game and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, data, business or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for direct damages will not exceed the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) USD $50.

12. Indemnity

You agree to defend, indemnify and hold harmless Omoggle Game, its affiliates, officers and contractors from any claim, demand, loss or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect any change. Material changes will be posted on this page at least 14 days before they take effect. If we have a billing email for you, we will also send notice to that address. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing law & disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-laws rules. Courts at the operator's domicile have jurisdiction, except where mandatory consumer-protection law lets you bring the dispute in your country of residence. Before filing, email support@omogglegame.com so we can try to resolve the issue informally.
